This story sounds like something you would hear out of China, not the United States. In Gould, Arkansas the city council is planning to pass an ordinance that forbids any group from forming or gathering that will discuss city matters without first getting city council approval – a clear violation of the First Amendment.

They mayor is dead set against it but it appears from the video that they can override him:

This is tyranny on steroids. I can’t imagine this will stand up in court but it appears that the city council wants to test that theory. Just unbelievable that they would even do this. They must be really crooked if they want to silence people in this manner.

Arkansas State Constitution Article 2 Section 4. Right of assembly and of petition.
The right of the people peaceably to assemble, to consult for the common good; and to petition,
by address or remonstrance, the government, or any department thereof, shall never be abridged.

I’m pretty sure this backs up the Mayor’s position.

    • http://www.therightscoop.com/ therightscoop

As if that is even necessary. I hope they get sued by every person in the city.

      • http://punditpawn.wordpress.com PunditPawn

Yes, you can sue. But the taxpayers shoot themselves in the foot paying for private attorneys while public city attorneys act against them with impunity. Basically a lawyer’s wet dream.

There’s got to be a conservative rights group that would do this pro-bono, right?

Being as the Mayor is the “chief executive officer” of the city, he has the city attorney’s office at his disposal I believe.

        • http://www.kennethballard.com Kenneth

Actually the ACLU would take this on in a heartbeat. They love cases where there is a clear First Amendment violation, and merely mentioning ACLU during the City Council meeting might just be enough to get them to back off.

        • Anonymous

Doesn’t need to be conservative. The ACLU would jump all over this

      • KenInMontana

Ah but that gives the people “standing”, which we constantly hear from the courts as a requirement for legal action.

As well as basic 1st Amendment [US Constitution] right of free speech, I would think.

      • KenInMontana

Ah but you see the US Constitution specifies that “Congress shall make no law…” ,which is why the states recognized this shortcoming and authored Constitutions of their own to reinforce those rights with protection from a broader range of assaults. By specifying “The right of the people…. shall never be abridged, they gave a much broader protection to that right.

    • Anonymous

They must think that document to be a dinosaur of the evolving legal system. Its all relative. Why do you have to go around trying to restrict these people? Maybe you should get the people together to go outside of city limits and discuss local public policy. Just outside the city limits would be preferable. If you advertise it, you would then be guilty of conspiracy to commit the crime of first amendment exercising. So be careful.

That Quartzite, Arizona case is turning out to be another situation like Ball, CA…where the town councilmembers have been milking the town dry.

Quite right Persephone. “Transparency in government” another example of an Orwellian attack on language. What that really means is lets hide what we’re doing from the uneducated masses.

      • Anonymous

We are not necessarily uneducated, just dumbed down and kept in the dark.

        • Anonymous

Correct. Forums like the internet are opening a lot of eyes to the truth. Wait till you see the rationalization that comes before they come after this means of spreading the news of what’s really going on in this country. It will probably take the form of national security.

          • Anonymous

Seems like national security is what is shaping the country. Probably a big part of our economy as well.

          • Persephone

Every time I hear about another big ‘hack attack’ against a large business or governmental department…it gives me pause.

We are being herded in so many little ways, into giving up freedoms in the name of ‘security’
Shutting down the internet, or severely curtailing our ability to communicate freely, could be done for the same reason…in the interest of eliminating a proclaimed ‘threat’ to our national security.
When, how do we know that the increased threat of cyber-hacking wasn’t something that was orchestrated to create yet another faux ‘crisis’?

  • Anonymous

This problem is happening in other places, I wonder if it is coordinated? Look at what is happening in Quartzite, AZ.

The danger is that it takes so little effort for these tyrants to impose these rules and such a great effort to fight it. This kind of thing will lead people to decide to shortcut the legal system and decorated the lamp posts of their fair city with “Councilmen” ornaments. A much quicker response than a months long legal battle. I see this coming and it won’t be pretty.

    • Anonymous

Some believe that we are currently living in a mild state of martial law, and this is due to this kind of thing. Others just think that this is preparing for martial law. I do believe that there is some sort of coordinated effort coming down from the feds to get local government to comply with such tactics that resemble martial law, or are leading to it. The reason I believe this is because of all the training that they receive that has been made public. Not to mention the people I know that have had this training. Even larger business managers I know have had to go to it. A couple of police I know have as well. When you look at the big picture, it is hard to conclude that there is not a plan for some future move on the federal government side.

      • Anonymous

Has anyone noticed the gradual paramilitary appearance of local law enforcement over the last 10 years or so? Military high and tight haircuts etc? The speed of the team is the speed of the leader. His royal highness currently living in your White House has said he wants a “Domestic Security Force, as well trained and financed as our standing military” Everywhere you care to look you see attacks on our rights and our Republic form of government which, in the past has made us the light of the world and the greatest country that ever existed. History shows that great countries decay from within, maybe they also can be saved from within.

        • Anonymous

You darn tootin’ we are going to save it from within! We’ve got to. It already feels like a soft dictatorship. I for one have had it. If I didn’t see the stories every day, I simply would not believe this of the country I was raised in. Nobody could compete with us. We are being destroyed from enemies of the domestic kind. There can be no doubt that Evil is afoot. It is more blatant with each passing day. Here is the triple threat IMO.

          1. Progressives
          2. Unions
          3. Islam

I am ready for young people to rise up too and rebel against the current system as they did in the 60′s, only this time, the system is Marxist. Another great generation…time to suit up.

          • Anonymous

Rshill7: Progressives (liberals) and unions are intertwined, cause and effect. Radical Islam is ready to pounce seeing the destruction of our country as a result of them. As for our young people, they have been attacked for a long time, poor schooling, teachers unions, indoctrination by liberal teachers, electronic game distractions, gratuitous grade promotions (have to be aware of their self esteem) lack of expectations, poor examples (look at the Atlanta school fiasco, which is probably the tip of the iceberg) and in so many different ways. You are right. Something has to happen to save this country. It’s not going to be pretty but it will be worth it. 1776 showed that.

The kinds of weapons are not normal for their departments, and nobody really knows why it is happening.

10 Years???? This has been going on since the Start of the Drug War…

Almost all Violation of Personal Liberty and Freedom can be traced directly back to the start of the Drug War, this gave the government a population that willing gave away their essential liberty in favor of perceived safety and solutions to a over hyped non-problem. Then 10 years ago on Sept 11 2001 the government got MORE people in that population to give away MORE of their essential liberty in favor of perceived safety and solutions to a over hyped but real security problem.

And now people stand back and say “How can they do this” the answer is WE GAVE AWAY OUR LIBERTY, and now we will never get it back, at least not in my lifetime…..

Historically, once the commies seized enough power, they ALWAYS turn violent and murderous against citizens who oppose them (ie. Over 20millions Chinese were massacred by Mao during the Cultural Revolution). This is coming to America. Only question is: WHO WILL SHOOT FIRST.

    • http://www.theancient.us The Ancient

No the question is, will the local police force stand with the Oath’s they take to uphold the constitution, or will they stand with their political paymasters on the Town Council???

This is a simple, non-violent action by the Council and a good test case as to if what people like Glenn Beck and other Police Defenders believe is true, that the police will in the end stand with the people and freedom, or if people like Me are correct and that the Police will do anything they are told to do by their masters even if it is unconstitutional, immoral or unjust as long as there is a “legal” order to do so.

      • Anonymous

I agree with your assertion that most law enforcement will just follow orders. There are those who go against the grain, but they are a minority by far. I just watched Camp FEMA 2 on youtube. There is one such police officer on there who speaks about his training. Pretty scary stuff.

      • KenInMontana

I think how the police forces react will depend a great deal on what city they serve, large metropolitan forces will most likely follow the government’s lead as these forces are more often than not staffed by a majority of officers from other locales who do not feel connected to the city in which they serve, where as smaller municipalities and towns tend to be made up from a majority of local people that are more closely tied to their communities.

This type of fascism is why I cringe whenever I hear Tea Party types talk about how “local government” is so much better than the Big Bad Evil Federal Government. Too many conservatives use “states rights” and “local control” as a panacea to the ill of federal power. This romanticized notion of small town politics is just that. Anyone who has ever had to deal with a local zoning board knows you can’t get any closer to tyranny than that.

That said, I have to say that I found this story extremely frustrating. I went to the stations website and I tried Google and I was unable to find any article that fleshes out this story. The story makes no sense the way it is presented in the video and the two articles I found written by the reporter in the video were poorly written and had no details that explained anything beyond what the video says. Bad Journalism 101.

Jaynie, If the Constitution of the United States is followed, it protects us from such tyranny, at all levels of government. That City Council appears to be ignoring the 1st Amendment and is in violation of the Constitution. I do not speak for the Tea Party, but the Tea Party works to influence government at all levels, to follow the Constitution.

Why does Sonja want to step on her brothers and sisters like this? Could it be that loyalty to one’s race is not as powerful as political power?

RS, this appears to be bigger than a First Amendment battle. This sounds like an attempt to draw the federal government into states rights again. The Bill of Rights is an explanation of the restrictions on the Federal govt. The Federal Govt cannot rule on an issue between citizens and state govt. This must be handled at the state level. As Ken said below, if the council passes this ordinance they are in direct conflict with their own state constitution. The Governor of Arkansas can and should have them served.
